DATA PROTECTION NOTICE
In the context of the data control carried out by it, Probate Research Hungary – Magyar Örököskutató Iroda Kft. pays special attention in your interest to complying with Act CXII of 2011 on informational self-determination and the freedom of information and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), as well as other data protection legislation in force and the data protection practice developed by the Hungarian National Authority for Data Protection and Freedom of Information in the course of its activities (see: http://www.naih.hu/index.html), also taking into account the major international recommendations related to data protection.
Probate Research Hungary Kft. Processes the personal data you disclosed to the Office as laid down below. The scope of the declaration covers all processes of all organisational units of the Office during which personal data defined by Act CXII of 2011 on informational self-determination and the freedom of information and the EU General Data Protection Regulation (GDPR) is processed.
The terms used in this declaration have the meaning given to them by the Info Act and the EU General Data Protection Regulation (GDPR).

Data Processing on the Website
Anyone can access the website of Probate Research Kft. without disclosing his/her identity and personal data and obtain information from the website and the pages linked to it freely and without restriction. However, the website collects non-personalized information about the visitors indefinitely and automatically. Such data is not suitable for extracting personal data, so it does not constitute processing within the meaning of the Info Act and the EU General Data Protection Regulation (GDPR).
While maintaining the Internet connection by means of the Web browser used by the visitor, technical data linked to the Internet Protocol address (IP address), domain name (URL), the time of the visit and the pages viewed are mapped automatically in the service provider's computer system. We use such data exclusively for analysis and collecting statistical information related to the website.
Anybody can contact the Office at the public contacts of the Office and by using the “Contact Us” menu item of the website. When making a contact, the data subject decides on the processing of the personal data he/she discloses. The legal basis for the processing is provided by the data subject by disclosing, based on prior notice, such data in order to contact the Office.
Legal Basis for Processing
Probate Research Kft. Enters into an agency contract with its clients. In this case, the purpose of processing is the performance of the services and obligations assumed by the Data Controller and the enforcement of rights, as set forth in the agency contract, the identification of the client and liaising and communication with the Client. Processed data: Principal’s/client’s name, mother’s name, place and date of birth, home address, personal ID, tax ID and ID card number.
Probate Research Hungary Kft. Processes the personal data of its principal within the framework of the agency based on the data subject’s consent pursuant to Article 6(1)(b) of the EU General Data Protection Regulation (GDPR) and point a) of Section 5(1) of the Info Act. The Data Controller shall not use the personal for any purpose other than the performance of the agency contract. The data disclosed is processed based on the data subject’s consent. Even for the purposes above, processing shall be limited to the extent and time necessary for the purpose and involve only personal data which is absolutely necessary for achieving the purpose of the processing and is otherwise suitable for achieving such purpose.
The Data Controller does not collect sensitive data, that is, data relating to racial, national or ethnic minority origin, political opinion or party affiliation, religious or ideological belief, membership of any organisation for the representation of interests, state of health, pathological addictions, sexual orientation or data pertaining to criminal records.
Duration of Processing
Probate Research Hungary Kft. processes the data during the term of the agency contract. The Data Controller will delete the personal data at the request of the principal to that effect.
Security of Processing. Data Protection. Rules of Processing
The Data Controller shall ensure that the data provided by the data subjects is stored securely in accordance with the EU General Data Protection Regulation (GDPR) and the Info Act. In processing the data, the Data Controller shall apply technical and organisational measures, as well as rules of procedure that ensure the avoidance of unauthorized access to, alteration, transmission, disclosure, erasure or destruction of the personal data, so they are suitable for enforcing the data protection and confidentiality rules.
The employees engaged in processing in the organisational units of the Office and entities engaged in any operations involving processing on behalf of the Office shall keep as business secret the personal data they come to know.
Probate Research Hungary Kft. Pays special attention to processing the data securely, so it takes all the technical and organisational measures and designs rules of procedure that are required for enforcing the Info Act and other regulations on data protection and confidentiality. The Office manager defines the organisation of data protection and the tasks and competences concerning data protection and the related activities taking into account the specificities of the Office, and assigns the person overseeing processing.
In carrying out their job, the staff of the Office shall ensure to prevent unauthorized persons from inspecting the personal data and protect the personal data from unauthorized access, alteration, disclosure, erasure or destruction, as well as the accidental destruction and damage or becoming inaccessible arising from changes of the technique used.
Enforcing the Rights of Data Subjects
A client is entitled to request information about the processing of the data concerning him/her. Probate Research Hungary Kft. provides information to the client regarding the data of the data subject processed by it or the data processed by the processor engaged by it or under its instruction, the source of the data, the purpose, legal basis and duration of the processing, the name and address of the processor and its activities related to processing and, in the case of transmission of the personal data of the data subject, the legal basis and the recipient of the transmission. We must provide the requested information in writing and as soon as practicable and no later than within 30 days from the day the request is submitted.
If the person subject to the declaration becomes aware that any personal data processed by the Office is incorrect, incomplete or untimely, he/she is obliged to rectify it or initiate the rectification thereof at the staff member responsible for recording the data. Clients may request erasure or blocking the data concerning them with regard to voluntary processing.
Data subject may object to processing their personal data according to Section 21(1) of the Info Act and Article 21 of the EU General Data Protection Regulation (GDPR). The Data Controller will examine the request within the shortest possible time and not more than 15 days from the receipt of the objection and adopt a decision as to merits thereof and notify the applicant of its decision in writing.
Data subjects may enforce their rights related to the protection of their personal data before the court and file a complaint with the Hungarian National Authority for Data Protection and Freedom of Information (address: 1125 Budapest, Szilágyi Erzsébet fasor 22/c; postal address: 1530 Budapest, Pf.: 5.; telephone: +36 1/391-1400; e-mail: ugyfelszolgalat@naih.hu).
Other Rules
Data are processed primarily in an automated way by using IT equipment, limiting or excluding the possibility of intervention for the system operator.
Probate Research Hungary Kft. may engage according to the provisions of the Info Act to carry out certain maintenance and other tasks. The processor may access to personal data to the extent absolutely necessary for carrying out these tasks. Probate Research Hungary Kft. Provides information at the data subject’s request on his/her data processed by the processor engaged by it, the name and address (seat) of the processor and its activities related to processing.
Miscellaneous Provisions
This Data Protection and Processing Notice is valid from 24 May 2018 until withdrawn.
The Data Controller reserves the right to change this data protection notice.
